W. H. Lynch, an owner of a small sawmill at Fred, in Tyler County, requested to ship timber and finished product over the Kirby Lumber Company tram at Silsbee. Company officials, after considering the request, denied the use of their tram to Lynch, citing the advice of the company legal department, which wanted to avoid any possibility of exposing Kirby Lumber to the laws involving common carriers.
